EC - Safe Drinking Water Act

Under the Safe Drinking Water Act, the Envronment Protection Agency is required either to approve individual state plans for controlling the discharging of wastes into underground water or that they enforce their own plans for states without adequate regulations.

The subject of the phrase is the Environmental Protection Agency (EPA), not the "states without adequate regulations". This eliminates options (B) and (C) misreferencing the states with "they". Now taking the essential form «the EPA is required either to (action A) or (action B)»

It seems that option (E) "... or to enforce its" (an action) will be preferrable to "... or it should enforce its " (an indirect obligation to take action).
